Bomb threat and assaulted crew

 SINGAPORE: On Wednesday (Sep 28), the Singapore Police Force (SPF) was informed of a bomb threat on board Singapore Airlines flight SQ33, travelling from San Francisco to Singapore.

This idiot does not know what he is going to face for committing such a stupid act! This is Singapore and unlike other countries he may be sentenced to jail and get at least 3 to 6 strokes of the cane. Besides the bomb hoax, he also assaulted a member of the cabin crew. From my perspective, this is intolerable! As an ex crew I am watching this case closely.

Hi, BT, the process might take a while. If I am not mistaken, I believe the Attorney-General Chambers (AGC) will arrange for the accused person to be sent to the Institute of Mental Health (IMH) for observation to determine if he is fit to stand trial. Firstly, this is a major and significant event and, secondly, amongst other reasons, to pre-empt the accused person's lawyer arguing that his client was mentally unstable. When a lawyer defend a person, he believe in 2 factors - the first is that his client "DID NOT" do it and, the second is that, "IF" his client, "DID it", he did not know that, "AT THAT TIME" what he did was wrong (for example, mental issues). Of course the other factor to consider is the fees, ha ha.

At the same time, the investigation proper will proceed and this will also take some time.

We shall see how it goes. People like this should be dealt with harshly - lock him up and throw away the keys.

Hi, BT, in our laws, we have the "Hijacking of Aircraft and Protection of Aircraft and International Airports Act 1978". Section 3 (1) of the Act provides that:-

3.—(1) Subject to subsection (2), a person who unlawfully and intentionally seizes or EXERCISES CONTROL OF THE AIRCRAFT IN SERVICE BY THE USE OF FORCE OR USE OF THREATS of any kind, or by any technological means, commits the offence of hijacking, whatever the nationality or citizenship of the person, whatever the State in which the aircraft is registered and whether the aircraft is in Singapore or elsewhere.

From what I read in the media, he made a verbal threat and, hence, the question is whether by his threat did he "exercised any control of aircraft". The lawyer might argue that he was drunk, mentally instable, etc., and was in no way in control of the aircraft as he was not in the cockpit.

However, there is another provision that will definitely be used, namely, Section 4, which provides,that "Any act of violence against the passengers or crew of an aircraft in service done by a person in connection with the offence of hijacking committed or attempted by him or her on board that aircraft is deemed to have been committed in Singapore and constitutes an offence punishable under the law in force in Singapore applicable thereto..."

Like you said, it will be interesting to know how he will be charged and how his plea will be.
